Hon’ble Apex Court Commuted : Death Sentence Of A Man Convicted For Rape And Murder Of A Four Years Old Girl

 

Very recent the Hon’ble Apex Court commuted the death sentence given to a man (Mohd Firoz) who is accused of murder and rape of a four years minor girl.

 

 

 

 

 

 

As per the Bench of Justices UU Lalit, S Ravindra Bhat and Bela M Trivedi the maximum punishment prescribed might not always be a determinative factor when it comes to repairing the crippled psyche of the accused.

In the instant case, the accused (Mohd Firoz) was given the death sentence by the trial court for offence u.s 302 and also under other relevant provisions of IPC and also under the POCSO Act. The accused appealed against the conviction and was dismissed by the High Court and the death sentence was confirmed.

 

 

 

 

 

 

In appeal, the Apex Court even though confirmed the conviction U/S. 302, it commuted the death sentence with the sentence of rigorous imprisonment.

In this context, the Supreme Court opined that in all cases the maximum prescribed punishment might not always be useful for repairing the cripple psyche of an offender.

 

 

 

 

 

 

Accordingly, the court commuted the sentence to 20 years imprisonment instead of imprisonment of life and clarified that all sentences are to run concurrently.
