Jharkhand High Court : MP-MLAs Not Allowed To Put Name Plates On Their Private Vehicles

 

Jharkhand High Court after the displeasure, the state government has withdrawn the acquital of installing name plates on the personal vehicles of MPs and MLAs.

 

Now only government vehicles are allowed to install name plates.

 

 

 

 

 

In fact, in the court of Chief Justice of Jharkhand High Court, Dr. Ravi Ranjan and Justice S.N. Prasad, there was a hearing in the matter of name plates and boards of the state’s MLAs, MPs and other public representatives in their private vehicles.

During the hearing, the affidavit filed by the Transport Secretary was withdrawn, in which the government had asked the public representatives to give permission to put name plates on private vehicles.

 

 

 

 

 

 

The court said that when the notification issued by the government has given exemption to install name plates or boards only on government vehicles, then how MPs and MLAs can put name plates on private vehicles. How can such an affidavit be filed on behalf of which the matter is said against the notification?

When there is no rule, how were they exempted? The Court said that.

 

 

 

 

 

After this, the State Transport Secretary K.K Son had requested the High Court to withdraw the said affidavit, which was accepted by the court and the court asked the government to introduce the rules for installing name plates on vehicles.

Instruction to file reply to the government in four weeks: The court asked the Advocate General to ask for the rules of other states and present them in the court on the next date, so that it can be known that what is the provision there and what has been implemented in Jharkhand.

1. Heard the parties.

2. We have also heard Mr. K.K.Sone, Secretary, Transport Department, Government of Jharkhand, who is appearing through Video Conferencing mode. The affidavits filed earlier on the query of the Court as to how an affidavit could be against the contents of the notification of the State of Jharkhand.

3. The Secretary, Transport Department, seeks leave to withdraw such paragraphs of the affidavit in which the statements regarding allowing of fixing of the plates on the private vehicles of M.L.As and M.Ps. is withdrawn. We permit and such part of affidavit now stands deleted. Now we would request the learned Advocate General to collect similar notifications of other States also so that we will be in a better position to deal with the matter and bring those notifications of other States on record. -2- Let the State file a report regarding the implementation of the aforesaid notification and what actions are being taken or had been taken against the violators by the authorities so that we could understand that this notification has been effectively implemented or not.

4. Put up this matter on 14.01.2022.

5. The personal appearance of Mr. K.K.Sone, Secretary, Transport Department, Government of Jharkhand, is dispensed with for the present.
