Madhya Pradesh High Court Quashes : 498A, FIR Filed By Wife Against In Laws, Saying It Was Filed To Take Revenge And Harass

 

Very recent, the Madhya Pradesh High Court quashed an FIR filed by a wife against her -in-laws U/S. 498A IPC after observing that the FIR was filed to wreak vengeance and with a revengeful intent to pressurize and harass her in-laws.

 

 

 

 

 

 

These observations were made by the Bench of Justices RK Srivastava while dealing with an application filed U/S. 482 Cr.P.C that are moved by the Applicants who sought directions from the court to quash the FIR and subsequent proceedings registered against the.

Before the court, the applicant stated that the wife was quarrelsome and was unable to adjust with her in-laws and husband therefore the husband filed an application for divorce. 

 

 

 

 

 

 

 

It was further stated that the father-in-law also got a complaint registered against the wife, pursuant to which the wife got the impugned FIR registered, and therefore the FIR should be quashed as it was filed with an intention to take revenge.

Significantly, the court noted that the wife had filed the FIR against the applicants after conciliation proceedings failed and according to the court, the wife filed the impugned FIR to wreak vengeance and also with a revengeful intent to harass and pressurize the petitioners.

 

 

 

 

 

 

 

Observing thus, the court allowed the applicants’ petition and quashed the FIR and subsequent proceedings against them
