Not To File Charge Sheets Against Ex-Mumbai Police Commissioner Param Bir Singh : Hon’ble SC Direct To Maharashtra State Police

 

On 6th December, 2021 (Monday), the Supreme Court obstructed to Maharashtra state police from filing charge sheets against Ex-Mumbai Police Commissioner Param Bir Singh. 

Nevertheless, the Court explained that during the investigation in the case will continue and counter-affidavits can be filed within one week.

 

 

 

Hon’ble Supreme Court also extended the interim protection that had given to Paramvir Singh earlier.

During the hearing of a suit challenging Bombay High Court judgement which was dismissed the petitions challenging investigation of the State Home Ministry against Param Bir Singh on corruption charges that directions were made by a Bench of Justices S.K. Kaul and M.M. Sundresh

During the hearing, the Court asked the CBI’s view in this case and Solicitor General Tushar Mehta who appeared for CBI stated that they had no objection in handing over the case to CBI. At this juncture, Justice S.K. Kaul observed that there is a possibility that the CBI could be asked to investigate the case.

 

 

 

Senior Counsel Darius Khambata appeared for the Maharashtra Government and submitted that the case should be transferred to the Central Administrative Tribunal but later the court replied that it might send a wrong message.

 

 

 

 

For Mr. Param Bir Singh, Senior Counsel Puneet Bali submitted that he wants a fresh investigation in this case. It further stated that even though the case is pending in the Hon’ble Supreme Court, the State Government claims that the investigation is complete.

 

 

 

The Court assured Mr. Khambata that the relief granted to Singh will remain intact. After hearing the contentions, the Bench opined that prima facie investigation of the matter should be done by an agency other than the Maharashtra police.
